These Conditions of Use and Purchase regulate the access and use of the website www.thebeeminelab.com (hereinafter, the “ Website ”) owned by LABORATORIOS BEEMINE SL (hereinafter, “ Beemine ”).


Access and/or use of the Website grants you the status of user (hereinafter, the “ User ”) thereof and implies acceptance, from said access and/or use, of these Conditions of Use and Purchase. Beemine reserves the right to modify or change these Conditions of Use and Purchase at any time. In the event of a substantial modification or when required by applicable regulations, Users who have a current relationship will be notified.

Access to and navigation of the Website will not require registration by Users and will be completely free of charge.

  • These Terms of Use (hereinafter, the “Terms of Use” ) regulate the use of the Beemine Website by the User.

  • ACCESS TO THE SERVICE

  • Access and/or use of this Website grants the applicant the status of User, who accepts, from said access and/or use, the present Conditions of Use. The aforementioned Conditions of Use will be applicable independently of the Conditions of Purchase that may be mandatory.


  • Registration on the Website

  • The User assumes responsibility for the use of the Website. This responsibility extends to the registration that may be necessary to access certain services or content on the Website. In such registration, the User will be responsible for providing truthful and lawful information.

    In order to register as a User and purchase products or services on the Website, it is a requirement to be over eighteen (18) years of age and to have provided all the data required and classified as mandatory. Likewise, the User assumes that the password and the User account are personal and non-transferable.

    The User will provide the password in accordance with the rules of strength and complexity established at any time by Beemine. The password created by the User will have an unlimited validity period, subject only to the time that the User's account remains active. Without prejudice to the foregoing, the User may change his/her password at any time, using the tools made available to him/her by Beemine through the User area.

    The User undertakes to make diligent use of his/her password and to keep it secret, and may not transmit it to any third party. Consequently, Users shall be responsible for the proper custody and confidentiality of any identifiers and/or passwords they have selected as registered Users, and undertake not to transfer their use to third parties, whether temporarily or permanently, or to allow third parties access to their account. The User shall be responsible for the lawful use of his/her account, and shall be liable for any damages caused by a third party who accesses it using his/her access credentials.

    Pursuant to the above, it is the User's obligation to immediately notify Beemine of any event that may allow the improper use of the identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed with their immediate cancellation. As long as such events are not communicated, Beemine shall be exempt from any liability that may arise from the improper use of the identifiers or passwords by unauthorized third parties.

  • Registered User Status
  • Access as a registered User of the Website will begin once the data required to register or make a purchase has been entered, and after acceptance of these Terms of Use. In the case of registering an account, access as a User will remain valid until the User requests deregistration.

    The User may enter the billing information once he/she makes the purchase. The information entered by the User must be true, and Beemine is not responsible in cases where the User, whether voluntarily or involuntarily, enters information that does not correspond to reality.

    Beemine reserves the right to deny any attempt to access the Website, cancel accounts, remove or modify content, or cancel the provision of services in cases where the Website is used incorrectly.

  • The User may purchase the products described on the Website by completing the purchase form with their billing and shipping information and accepting these Terms of Use and Purchase, as well as the Privacy Policy.


  • GENERAL

  • The headings of the various clauses are for informational purposes only, and shall not affect, qualify or expand the interpretation of these Terms of Use.

    The Terms of Use in force will be those published on the Website. Beemine may modify the conditions stipulated herein, in whole or in part, by publishing any changes in the same manner in which they appear or through any type of communication addressed to Users.

    Beemine may terminate, suspend or interrupt access to the contents of the Website at any time and without prior notice, without the User being able to demand any compensation.     All clauses or provisions of these Terms of Use must be interpreted independently and autonomously, and the rest of the provisions will not be affected if one of them has been declared void by a final court judgment or arbitration decision. The affected clause or clauses will be replaced by another or others that preserve the effects sought by these Terms of Use.

    The non-exercise or execution by Beemine of any right or provision contained herein shall not constitute a waiver thereof, unless acknowledged and agreed to in writing by Beemine.

    Beemine reserves the right to exercise all civil and criminal actions that may be legally applicable in the event of non-compliance with these Terms of Use, as well as any improper use of its Website by the User.


  • INTELLECTUAL AND INDUSTRIAL PROPERTY

By using this Website, or placing an order through it, the User agrees to be bound by these Conditions, so if you do not agree with all of the Conditions, you should not use the Website.

    These Terms may be modified. It is your responsibility to read them periodically, as the conditions in force at the time of use of the Website or the placing of an order will be those applicable to you.

  • PURPOSE AND OPERATION OF THE WEBSITE

  • The Website makes available to Users the purchase of the products offered on it (hereinafter, the “ Products ”). These Purchase Conditions regulate the conditions of purchase of the Products offered by Beemine through the Website.

    The Website will indicate those Products that are available in Stock, and that therefore users can purchase at the time they wish to buy them.

    The User may order products on the Website by selecting them and placing them in his or her shopping basket. Before purchasing the Products described through the Website, the User is obliged to read and accept these Purchase Conditions.


    3.1 User Registration


    The User may register on the Website by completing the registration form where personal data will be requested, which must be up-to-date and accurate. Upon completion of the registration process, the User must accept these Terms of Use and Purchase, as well as the Privacy Policy.

    Users shall be fully responsible for the use of their User account. Consequently, Users are responsible for the proper custody and confidentiality of the User name and/or passwords that allow them access to their account, and they undertake not to transfer their use to third parties, whether temporarily or permanently, or to allow third parties to access them.

As long as such facts are not communicated, Beemine shall be exempt from any liability that may arise from the misuse of User names or passwords by unauthorized third parties.

    3.1. Orders and conditions of sale

    The User may access and purchase Beemine products without having to register on the Website.

    The User must complete the purchase form, entering their personal identification, billing and shipping data, to proceed with the purchase.

    The data entered by the User must be true and accurate, and Beemine is not liable in cases where the User, whether voluntarily or involuntarily, enters data that does not correspond to reality. In the event of an error, Beemine is not liable for any delay in delivery .

    The data entered by the User in the purchase form will remain stored by Beemine until the purchase has been made, and for the time necessary for Beemine to diligently fulfill its obligations.

    By registering or making a purchase on the Platform, the User declares to be over 18 years of age and to have the legal capacity to enter into contracts.

  • PRICES
  • All Product prices indicated on the Website do not include shipping costs, are expressed in Euros and include VAT and other taxes that may apply.

    The prices shown on the Website correspond to an assigned rate valid for an annual period. Some Products may be subject to price variations depending on fluctuations in market costs.

    Beemine reserves the right to modify current rates or apply discounts to such rates.

    Products will be billed at the price in effect at the time of the order, except for promotions and/or campaigns.

    In any case, the final price, including shipping costs, will be shown to the User at the time of making the actual purchase.

  • SHIPPING AND DELIVERY TIMES

  • Product Delivery
  • Beemine undertakes to deliver the Product in perfect condition to the address indicated by the User. In order to optimise delivery, we would be grateful if the User indicated an address where the order can be delivered during normal business hours.

    Beemine will not be liable for errors caused in delivery when the delivery address entered by the User in the order form is inaccurate, does not correspond to reality, is false or has been omitted.

    Without prejudice to the foregoing, Beemine undertakes to take all measures within its power to ensure that orders are delivered within the agreed time, and if not, as soon as possible to the satisfaction of the recipient.

  • Delivery and notification period
  • The User must take into account that on certain dates and periods of the year, the delivery time of shipments could be affected, such as sales periods, Black Friday, Christmas, etc. due to the saturation of the means of transport. Therefore, it is recommended to purchase the items of interest well in advance so that they arrive at their destination on the dates desired by the User.

    Beemine informs you that it will not make deliveries on Saturdays and Sundays, or on national or community holidays, or on days that coincide with local holidays that could affect related transport activities.

    In the event that the User cannot be located at home, the courier company will leave a notice indicating where the order is and how to proceed with its collection.

    Shipping costs are not included in the price of the Products. However, the User will be informed prior to purchasing the Product.

  • Diligence in delivery
  • The User must check the good condition of the package before the carrier who delivers the requested Product.

    If the User detects any anomaly in the Product or in the event of an incident, he/she must indicate it on the delivery note and in turn notify Beemine by email to the following address: administracion@thebeeminelab.com

  • Delivery times
  • Delivery times nationwide range from 48 to 72 working hours. In rural areas far from urban centres, deliveries will be made after 72 working hours.

    Delivery times at Community level - within the EU - range between 72 hours and five (5) business days.

    International delivery times - outside the EU - range from seven (7) days to fourteen (14) business days.

    Delivery times will depend on the availability of each Product, which is indicated on each and every product offered. For orders that include several items, a single shipment will be made and the delivery time will correspond to the item with the longest delivery time.

    Under no circumstances will Beemine intentionally sell more units than it has available. In the event that the Product is not available after the order has been placed, the User will be informed and offered the option of delaying delivery or replacing the Product with a similar one, or, failing that, returning the amount paid.

    In certain cases and specific conditions or promotions, Beemine reserves the right to change the conditions and amounts of shipments.

    In case of any issues regarding the status of your shipment, you can contact Beemine via email: administracion@thebeeminelab.com so that Beemine can resolve your query or concern.

    Unjustified delays in delivery exceeding fourteen (14) calendar days will give rise to the right to cancellation of the order placed and the corresponding refund of the amount paid by the User, which may be returned within one (1) month from the cancellation of the same.

    Delays justified by force majeure, such as holidays, weather conditions, strikes, or any other delay attributed to the company shipping the Products or causes external to Beemine, cannot be attributed to Beemine and therefore the withdrawal cannot be exercised until the User receives their Product at the address provided.

    Furthermore, Beemine will not be held responsible for any inconvenience that may arise from the purchase being made in a country outside the European Union (EU). It is the User's responsibility to be aware of local regulations and act within the law.

  • SHIPPING COSTS
  • The User will be able to find out the shipping costs once the Products have been selected prior to formalising the purchase. However, the cost of shipping is as follows:

    Within the Peninsula:

    Shipping costs will be two Euros and ninety-five Euro cents (€2.95), and will be free for purchases over forty Euros (€40).

    For shipments to the Islands, Ceuta, and Melilla:

    Shipping costs to the Balearic Islands: shipping will cost eight Euros and thirty-five Euro cents (€8.35), and will be free for orders over eighty Euros (€80).

    Shipping costs to the Canary Islands: Shipping costs will be fifteen Euros and twenty Euro cents (15.20€), and will be free for purchases over one hundred and twenty Euros (120€).

    For international shipments, including Community shipments :

    Shipping costs will be fifteen Euros (15€).


  • RIGHT OF WITHDRAWAL

  • The User has a period of fourteen (14) calendar days from the date of receipt of the Product to exercise his right of withdrawal without incurring any cost.

    Without prejudice to the foregoing, as established in Article 103 of the General Law for the Defense of Consumers and Users, the User may not withdraw from the Product if it is unsealed, for reasons of health protection or hygiene. That is, the User may not exercise his right of withdrawal if the Product is not in its original state, including the seal thereof, except for the return of the Product because it is defective.

    To exercise the right of withdrawal, the User must complete the Withdrawal Form and send the Product to be returned along with the instructions, documents and packaging. The return shipping costs will initially be borne by the User.

    Once the right of withdrawal has been correctly exercised and, in any case, within a maximum period of fourteen (14) calendar days from receipt of the Product in the warehouses, Beemine will pay the invoice originally issued and return the full amount of the purchase to the User, excluding shipping costs, using the payment method selected by the User at the time of purchase. Such refund will be subject to Beemine's right to retain amounts for returned products that are damaged.

    Please note that the following form must only be completed and sent if the User wishes to withdraw from the contract, and must be sent together with proof of purchase of the Product.

    Likewise, if the User has received the package through the company TIPS@, the package to be returned may be collected at their home, provided that it is in a properly packaged package, including the return label provided upon receipt of the product, and the Withdrawal Form is completed and returned.

    In any case, when the Product is sent by post or courier service, the return shipping receipt will need to be sent to the email address administracion@theBeeminelab.com . Beemine will not be liable for any refund that has not been previously credited by sending said receipt.


    If you wish, you may return a Product to a physical Beemine establishment. To do so, you must first notify the email address indicated above, and once you have received confirmation, you may go to the central office in Madrid along with the Product and proof of purchase. For physical returns, the User will also be given the option to exchange the product.

  • PAYMENT METHODS

  • Payment is understood to be in cash and will be made through the means made available through the Website. Once the payment has been validated, Beemine will proceed to prepare the Product in the warehouse and proceed with its shipment. The User, when making the payment, must accept the terms of use and privacy policy of the payment service provider.


    Within a maximum period of twenty-four (24) hours, Beemine will send an email to the User, confirming the details of the purchase made. This email will detail the order, the personal data communicated and the order number to ensure that the purchase has been made correctly.


    Users are guaranteed that the payment process is carried out in absolute security, in accordance with the required security protocols and services.


    In the event that our warehouse detects the lack of availability of any of the Products included in the order, the customer will be contacted by telephone or email and will be informed of the new delivery time or, where appropriate, the impossibility of delivery of the same. In the latter case, the amount of the charged item will be refunded as soon as possible.

    The User must notify Beemine of any improper or fraudulent charges on the card used for purchases, by sending an email to administracion@theBeeminelab.com , as soon as possible so that Beemine can take the appropriate action.



  • PROMOTIONAL CODES AND DISCOUNT VOUCHERS

  • The applicable minimum spend established on the Website to validate any promotional code or discount voucher does not include shipping costs. If the User exercises the right of withdrawal on an order placed with a discount voucher, the amount subject to refund will be subject to the minimum spend applicable to said discount voucher.


    In this regard, if the amount of the returned items causes the remaining sum of the order to be less than the minimum spend applicable to the discount voucher, the amount of the discount will be deducted from the refund. For example, the discount of ten Euros (10€) (applicable to a minimum spend of sixty Euros (60€) will be deducted from the refund if the amount of the returned product(s) causes the total sum of the order to be less than 60€.


  • DEFECTIVE PRODUCTS

  • To return a defective Product, the User must send the Product by post or courier service, within a period not exceeding seven (7) calendar days from receipt of the Product, after notifying Beemine at the email address provided in these Purchase Conditions.


    The Product must be returned in the condition in which it was received, in its original packaging, together with the corresponding documentation (invoice or proof of purchase indicating the order number) and, once examined by Beemine, the User will receive an email within a maximum period of fifteen (15) days, confirming its return according to the damage assessment. Once the damage has been confirmed, Beemine will proceed to refund the total amount, including shipping costs, which will be made using the method selected by the User when making the first purchase.

    If the User is not satisfied with the Product because he or she believes there is a manufacturing defect, he or she must contact Beemine using the Contact form provided on the Website, selecting the subject “Product Received – my item is defective”, and provide as much information as possible about the problem with the Product(s).


    Yes, if you want us to replace the Product or refund the amount paid, you must ensure that the product:

    1. a) It has not been used incorrectly or negligently, has not been handled inappropriately or imprudently and has not been subjected to abnormal or harmful conditions.
    2. b) It has not been involved in any accident or damaged when attempting to repair or modify it.
    3. c) It has not been used in a manner contrary to that established by the manufacturer in the product instructions.
    4. d) It has not been damaged by natural wear and tear after receipt.

    In the event that the Product does not meet any of the above requirements, we may, at our discretion, decide not to replace the Product. To the extent permitted by law, we are not liable for any losses, liabilities, costs, damages or expenses that may result from the process.

    Returning an order with free shipping (which has not been provided with a discount voucher) will not affect the refund amount.


  • PRODUCT INFORMATION AND USE
  • All products in Beemine distribution channels are intended for legal use. Industrial hemp is listed in the Common Catalogue of plant and agricultural species varieties of the European Commission. The products for sale are intended for external body use, with the aim of cleaning, perfuming, protecting, and maintaining the human body in good condition (EC Regulation 1223/2009).

    Pursuant to the provisions of Spanish regulations and the decision of the European Commission in its official request to EFSA on “food supplements”, none of the products offered on the Website are suitable for human consumption, and therefore Beemine shall not be liable for any consequences arising from incorrect use of the product. It is the Buyer’s responsibility to make diligent use of the purchased product.

    None of the information made available by Beemine to the User is medical advice or a substitute for any diagnosis or treatment. If you are undergoing medical treatment, have been diagnosed or are pregnant, consult your regular doctor before using any of the available products.

    The data included on the Website in the Product descriptions have a purely informative function.

    At Beemine we make every effort to ensure that the Website contains as complete and accurate a description of the Products as possible. As our Products are regularly improved, the information provided about the Product (such as the listed ingredients) may be subject to change. We therefore recommend that you always read the packaging or instructions before using the Product.

    Beemine declines any responsibility for the appearance of errors in said information, although it undertakes to take all measures within its power to correct said errors or omissions as soon as possible after having been informed of them.

    If an offer has a limited validity or if special conditions apply, this will be clearly stated in the Product offer.

  • Beemine may review and modify these Purchase Conditions at any time.

    The User will be subject to the policies and Conditions in force at the time he/she uses this Website or carries out each transaction, unless by law or decision of government agencies we must make retroactive changes to said policies, Conditions or the Privacy Policy, in which case, the possible changes will also affect orders that had been previously made by the User.


  • INTEGRITY

  • These Conditions and any document expressly referred to herein constitute the entire agreement between the User and Beemine in relation to the subject matter hereof and replace any other prior agreement, understanding or promise between the User and Beemine, whether verbal or in writing.


    Neither the User nor Beemine shall have any remedy in respect of any untrue statement made by the other party, whether verbal or written, prior to the date of a contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these Terms.


    If any of these Conditions or any provision of a contract were declared null and void by a final decision issued by a competent authority, the remaining Conditions of Purchase will remain in force, without being affected by said declaration of nullity.


  • GENERAL

  • The headings of the different clauses are for information purposes only and will not affect, qualify or expand the interpretation of these Conditions of Purchase. Likewise, Beemine may modify the conditions stipulated herein, in whole or in part, by publishing any changes in the same way in which they appear or through any type of communication addressed to the Users.

    The Purchase Conditions published on the Website will be deemed to be in force.

    Beemine may terminate, suspend or interrupt access to the contents of the Website at any time and without prior notice, without the User being able to demand any compensation. After such termination, the specifications for use of the contents set out above in these Conditions of Purchase will remain in force.


    The non-exercise or execution by Beemine of any right or provision contained herein shall not constitute a waiver thereof, unless acknowledged and agreed to in writing by Beemine.

    The Purchase Conditions will be kept in electronic format by Beemine and will remain permanently available to the User.


    Beemine will pursue any breach of these Conditions, as well as any improper use of its portal, by exercising all civil and criminal actions that may be applicable by law.


  • APPLICABLE LEGISLATION

  • The sale is deemed to be carried out in Spanish territory, so for any interpretative or litigious questions that may arise, Spanish legislation will apply and, in the event of a dispute, both parties agree to submit, with waiver of any other jurisdiction that may apply, to the jurisdiction of the Courts and Tribunals of the Consumer's domicile.
